General Terms and Conditions of Sale

Article 1 — Purpose

These general terms and conditions of sale (GTC) govern the sales of photographs, in digital and/or printed form, carried out by Agence Bouillot (sole proprietorship, SIREN 920 591 724, 42 allée du coteau, 01310 Polliat) via this website. Any order implies full and complete acceptance of these GTC.

Article 2 — Products

The products offered are photographs taken during equestrian events, sold as downloadable digital files and/or physical prints. The characteristics (format, file or print type) are indicated on each product's page.

Article 3 — Prices

Prices are stated in euros, all taxes included. In application of Article 293 B of the French General Tax Code, VAT is not applicable (VAT-based exemption). Any delivery costs for physical products are indicated before the order is validated. Agence Bouillot reserves the right to modify its prices at any time, it being understood that products are invoiced on the basis of the rates in effect at the time of the order.

Article 4 — Order and Payment

The order is placed online via the site. Payment is made by credit card through our secure payment provider Stripe. The order is only definitively validated after payment confirmation. A confirmation and an invoice are sent by email to the address indicated by the customer.

Article 5 — Delivery

Digital products: the files are made available for download after payment confirmation, via a secure link and after retouching by our team.

Physical products: prints are shipped to the address indicated by the customer, within 2 to 5 business days after order confirmation. Delivery costs and zones are specified at the time of the order.

Article 6 — Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the customer in principle has a period of fourteen (14) days to exercise their right of withdrawal.

However, in accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for the supply of digital content not provided on a tangible medium, the performance of which has begun after the consumer's prior express consent and express waiver of their right of withdrawal. Consequently, by downloading a digital photographic file, the customer acknowledges that the service is fully performed and expressly waives their right of withdrawal for this product.
For physical prints custom-made on demand, the right of withdrawal may also not apply if these are goods made according to the consumer's specifications (Article L221-28).

Article 7 — Copyright and Usage Rights

The photographs are works protected by copyright. The purchase of a photograph grants the customer a personal and private right of use, excluding any transfer of copyright, which remains the exclusive property of Agence Bouillot.
Unless specifically agreed in writing, the customer is not authorized to: resell the photograph, exploit it for commercial purposes, modify it, or transfer it to a third party. Use for personal purposes (private printing, sharing on the personal social media of the rider depicted) is authorized.

Article 8 — Image Rights

The persons depicted in the photographs have rights to their image. The purchase of a photograph by a customer does not exempt them from respecting the rights of the persons depicted. Any person appearing in a photograph may request its removal via the contact page.

Article 9 — Complaints and Removal

Any complaint may be sent via the contact page. Requests for the removal of a photograph (image rights or GDPR) are processed as promptly as possible.

Article 10 — Liability

Agence Bouillot cannot be held liable for non-performance of the contract in the event of force majeure. Agence Bouillot cannot be held liable for difficulties or impossibility of accessing the site, downloading, or for any damage resulting from improper use of the products.

Article 11 — Personal Data

The processing of personal data is described in the privacy policy.

Article 12 — Applicable Law and Disputes

These GTC are subject to French law. In the event of a dispute, the customer is informed that they may resort to conventional mediation or any alternative dispute resolution method. Failing an amicable resolution, the French courts shall have jurisdiction.
